A – Access to Protection

The inquiry into the copyrightability of creations is, as we know, a delicate art. The two cases reported below show that the courts adopt very different approaches to the difficulty, merely making peremptory statements – concerning fashion shows and fashion designs – or engaging in a subtle analysis when dealing with photographs taken by paparazzi. The second approach is more complex, particularly in the face of a condition as elusive as that of originality (on the issue, see, for example, the thesis by Agnès Maffre-Baugé, L’œuvre de l’esprit empreinte de la personnalité de l’auteur, University of Montpellier 1, 1997), but it is the only one capable of satisfying the requirements of the discipline.
