Article L. 112-4 IPC provides in its firstparagraph that the titleof an intellectual work is protected if it is "original in character", without prejudice to the provision of its second paragraph laying down that the title of a given work may not be used to name another work "under conditions liable to create confusion".
A dispute concerning the exclusive ownership of the title of a scientific journal ("Cellular and Molecular Biology") was brought before the Paris Court of Appeal which settled it (2 June 1999, Wegmann case) without indicating the legal basis of the protection. However, it is true that the principle of the protection was not questioned.
The same ruling, which also states that a title may be lawfully registered as a trademark only with the agreement of the owner(s) of the copyright in the title,
